  • Filing requirements in the United Kingdom

The official language of proceedings before the UK IPO is English.

For obtainment of the date of filing a trademark application in the United Kingdom must contain:
- request for registration of a trademark;
- name and address of the applicant;
- list of the goods and/or services;
- representation of the trade mark;
- proof of payment of the prescribed fees.

Currently, the legislation of the United Kingdom does not require filing a Power of Attorney when filing a trademark application.

The submission of the Priority Document is not usually required.

The term for filing a trademark application in the UK claiming conventional priority is six months from the priority date.

  • Examination, publication and opposition to a trademark application in the United Kingdom

The application process includes an examination on absolute grounds.

If a trademark application has been accepted by the Registrar, it is published in the Journal. Within 2 months of publication, any person may file a duly reasoned objection to a registration of trademark application.

  • Grant, validity term and trademark renewal

No official grant fee is required to be paid. A trademark registration is valid for 10 years from the date of application. The registration is renewable for successive periods of 10 years. An application for renewal must be filed 6 months before the expiration date of the registration. The trademark may be renewed within six months after the renewal due date providing that a corresponding surcharge has been paid.

  • Duration of registration procedure

The processing time from first filing to registration is approximately 6 months provided that no objections are raised by the Registrar during the examination and no oppositions are filed.

  • Use requirement

Registration of the trademark in the UK can be cancelled on the grounds of non-use upon a third party’s request if it has not been used for five years from registration of a trademark.

  • Representation by a trademark attorney

For foreign applicants residing outside the United Kingdom it is recommended to perform the trademark prosecution in the UK through an agent, a registered UK trademark attorney.

2. The time limit for filing of a response to the provisional refusal of an international registration in the United Kingdom is 2 months from the date the Office issues the refusal. It is possible to request an extension of the time limit. The language of the response is English. For foreign applicants not residing in the UK it is necessary to appoint a local representative for filing of the response. There is an option to request a revision or file an appeal to the provisional refusal after a response to the provisional refusal has been submitted.
