  • Term for filing a patent application in Iran

The term for filing a patent application in Iran claiming priority is 12 months from the priority date. Restoration of this term is not applicable.

  • Filing requirements in Iran

It is necessary to submit the following documents with the Patent Office : full name and address of the applicant; full name and address of the inventor(s); titile of the invention; a certified copy of the Priority Document (if any); a Power of Attorney notarised and duly legalised up to the Iranian Consulate; a certified copy of the applicant's Certificate of Good Standing in the home country; specification, claims (in Persian and English) and four sets of drawings.

  • Language of the Iranian patent application

The official language of the Iranian patent application is Persian.

  • Priority document

A certified copy of the priority document should be provided on filing the application or within two months from the filing date.

  • Power of Attorney requirements

The original of the Power of Attorney should be notarised, legalised by the Iranian Consulate and submitted simultaneously with filing of the application in Iran or within 2 months from the filing date. The deadline for submitting the documents is 60 days from date of receiving the notice from the Patent Office. Extension for two months can be granted.

  • Incorporation Certificate

If an applicant is a legal entity, a certified copy of the Incorporation Certificate with an English and Farsi translations should be submitted within 60 days from the date of receiving the notice from the Patent Office.

  • Substantive examination request

The Patent Office of Iran examines patent applications for substantive grounds, checking similar/identical and prior patents filed. However, all patent applications in Iran undergo examination with a research institute or a university for novelty, industrial applicability and inventive step before patent granting. Examination with a research institute or a university starts automatically once the examination on formal requirements is completed.

  • Grace period

Novelty grace period in Iran is not applicable.

  • Grant and maintenance fees

The official grant fee should be paid within 60 days from receiving the Notice of Allowance. Maintenance fees must be duly paid by the applicant to the Industrial Property Office for the remaining period of the patent validity. The first annuity should be paid at the time of filing a patent application in Iran and subsequent annuities within 2 months before the anniversary of the filing date. Examination fees have to be settled after the submission of all required documents. Late payment is possible within a six-month grace period after the due date by paying a corresponding surcharge.

  • Representation by a patent attorney

For the foreigners, it is necessary to perform the patent prosecution in Iran through an agent, registered Iranian patent attorney.
