  • Minimum filing requirements in Cuba

For obtainment of a filing date, a patent application entering PCT national phase in Cuba should contain:
- request to register a patent;
- applicant(s) data;
- claims and description of the invention.

  • Language of the Cuban patent application

The official language of proceedings is Spanish. Translation of the international application should be filed within 60 days from the Cuban PCT national phase entry.

  • Power of Attorney requirements

The original of a simply signed Power of Attorney is required. Late filing of a Power of Attorney is possible on condition of payment of an extra fee.

  • Opposition period

Any third party has the right to file an opposition within sixty days after the publication of the application.

  • Substantive examination request

Substantive examination is automatically carried out after the opposition period. No additional request needs to be filed.

  • Grace period

Cuban IP legislation does not stipulate a six-month novelty grace period for inventions that were disclosed at an official or officially recognised international exhibition.

  • Grant and maintenance fees

Grant fees are to be paid within thirty days from issuance of the Notice of Allowance. A patent in Cuba is valid for twenty years as of the international filing date. Annual maintenance fees are payable starting from the third year of the validity term. The due date is the anniversary of the international filing date. Late payment is possible within a six-month grace period after the due date.

  • Representation by a patent attorney

For foreign patent applicants, it is necessary to appoint an agent, a Cuban patent attorney, to perform entry into the Cuban PCT national phase.
