  • Multiple classes

Multiple class trademark applications are possible in Iran.

  • Minimum of filing documents in Iran

To obtain a filing date, it is necessary to provide the Iranian Trademark Office with trademark application together with a representation of the trademark, list of goods or services for which registration is requested under the applicable class(es) of the International Classification, a certified Incorporation Certificate and payment of the prescribed application fees.

  • Requirements to the Power of Attorney

The Power of Attorney should be submitted within two months from the filing date. It should be legalised up to the Iranian Consulate.

  • Priority document

A certified copy of the priority document should be submitted within two months from the filing date. It shouldn’t be legalised or notarized. The translation of the priority document into Persian is required.

  • Opposition period

The opposition against Iranian trademark registration is 30 days from the publication of the registration.

  • Provisional Refusal

For filing of the response to a provisional refusal of an international registration in Iran, applicants must observe a 60-day time limit. Calculation of time starts on the date WIPO sends the provisional refusal to the applicant. There is no option to request an extension of time. For responding to the provisional refusal, it is necessary to appoint a local representative.

Requests to review or appeals against the Office’s decision are accepted only after the applicant has filed a response to the provisional refusal.

  • Grant, validity term and trademark renewal

The official grant fee should be paid within 60 days from receiving the notice of allowance. The trademark in Iran is valid for ten years from the application date. This period may be renewed for consecutive periods of ten years within one year before expiry of validity term. After the expiration of a trademark registration term, a trademark holder may be granted a six-month extension term for the renewal by payment of a surcharge.

  • Use requirement

The non-use grace period in Iran is three years from registration. After its expiry, any interested party may initiate the cancellation action based on non-use to the Board of Appeal of Iran.

  • Representation by a trademark attorney

For the foreigners, it is necessary to perform a trademark prosecution in Iran through an agent, registered Iran trademark attorney.
