  • Design fees

  • Multiple design application

Multiple design applications are not possible in Japan.

  • The term for filing an industrial design application in Japan

The term for filing a Japanese industrial design application claiming priority is six months from the priority date. Restoration of the priority right is not possible.

  • Minimum filing requirements in Japan

For obtainment of a date of filing, an industrial design application in Japan must contain:
- applicant's and designer's details;
- figures of the industrial design;
- specified goods.

  • Power of Attorney requirements

A POA is not required for registration of an industrial design in Japan.

  • Priority document

To confirm the priority right, a certified copy must be submitted within three months from the filing date of an industrial design application in Japan. The front page must be translated into Japanese.

  • Examination of a design application in Japan

A design application in Japan undergoes formal and substantive examination. No specific request for substantive examination of an industrial design needs to be filed with the JPO.

  • Grace period

The information on a design application does not disprove its novelty if such disclosure is made by the designer or on behalf of a designer within twelve months before the date of filing of the application in Japan.

  • Grant, validity term and maintenance fees

The grant fees are to be paid within thirty days from issuance of the Notice of Allowance. An industrial design patent in Japan is valid for 20 years from the date of registration. Annual maintenance fees are due from the second year of the validity term and should be paid by the end of the previous year. On request, the term may be extended by thirty days.

  • Representation by a patent attorney

To perform industrial design prosecution in Japan, foreigners must appoint an agent, a registered Japanese patent attorney.

  • What can be registered

Legal protection for industrial designs in Japan may be granted to new and original artistic solutions which determine the appearance of a product.

  • What cannot be registered

The following designs cannot be registered in Japan:
(i) a design which is liable to injure public policy;
(ii) a design which is liable to create confusion with an article pertaining to another person's business;
(iii) a design solely consisting of a shape that is indispensable for securing functions of the article.
