  • The term for filing design application in Morocco

The term for filing design application in Morocco claiming priority is six months from the priority date. It is possible to restore this term within three months from the missed deadline.

  • Minimum of filing documents in Morocco

To obtain a filing date, the design application in Morocco should contain:
- a request to file an industrial design;
- three copies of a graphic or photographic reproduction of the industrial designs and the title of the related graphic or photographic reproductions with a brief description;
- proof that the prescribed fees have been paid.

  • Multiple design applications

A single application may relate up to 50 industrial designs, provided that the said industrial designs are of the same kind.

  • Power of Attorney requirements

Copy of simply signed Power of Attorney should be filed within 3 months from the filing date. This term can be extended for additional two months upon payment of a surcharge fee. Legalization/notarization is not required.

  • Priority document

If the priority is claimed, priority document should be provided to the Patent Office within three months from the filing date of design application. Translation of the priority document into French is required.

  • Examination of a design application in Morocco

Industrial design applications in Morocco are based on the results of the formal examination; the substantive examination is not conducted.

  • Grace period

An industrial design or model is not deemed to have been disclosed to the public if it was first exhibited at an official or officially recognized international exhibition held in a country that is a member of the International Union for the Protection of Industrial Property, within six months prior to the filing date.

  • Grant and validity term and maintenance fees

The registration of industrial design in Morocco is valid for five years as from the date of application. It may be renewed for two new consecutive five-year periods. The registration must be renewed in six months prior to the expiry of its term of validity. Renewal fees can only be paid six months before the expiry of the design registration, and a six-month grace period is available.

  • Representation by a patent attorney

For the foreigners, it is necessary to perform the industrial design prosecution in Morocco through an agent, registered as Moroccan patent attorney.
