  • Patent fees

  • Deadline for the PCT national phase entry in Saudi Arabia

The term for entering PCT national phase in Saudi Arabia is 30 months from the priority date. The term may be restored if the applicant failed to file an application in spite of due care. A request for restoration should be submitted within 12 months from the missed deadline or within 2 months from the elimination of the cause of failure to file an application in due time, whichever is earlier.

  • Minimum filing requirements in Saudi Arabia

For entry into the Saudi PCT national phase, an application must contain:
- a copy of a PCT request;
- a copy of the specification of the invention;
- a copy of the International Publication;
- a copy of the International Search Report;
- priority data, if any.

  • Language of the Saudi patent application under PCT

The Arabic and English translations of the required documents are to be submitted at the date of the Saudi PCT national phase entry. It is not possible to submit the translation at a later stage.

  • Priority document

A legalised copy of the priority application should be submitted within 90 days from the Saudi PCT national phase entry.

  • Power of Attorney requirements

An original Power of Attorney legalised up to the Saudi Consulate may be filed within 90 days from the date of the Saudi national phase entry.

  • Assignment Deed

If the Saudi PCT national phase application is filed by a person other than the inventor, a legalised Assignment Deed between the applicant and the inventor must be submitted within 90 days from the national phase entry date.

  • Substantive examination request

No special request for substantive examination needs to be filed.

  • Novelty grace period

The disclosure does not disprove novelty of the invention if it occurred at an officially recognised international exhibition within the priority period, twelve months prior to the international filing date of the application or due to the arbitrary act against the applicant of his or her predecessor within six months prior to the international filing date or the date of priority, if any.

  • Grant and patent maintenance fees

Grant fee should be paid together with publication fee within 90 days from the notification by the Office. Annual maintenance fees are due starting from the year following the national phase entry date and should be paid from January 1 to March 31 of each year. Late payment is possible within three months after the due date and within a further grace period of three months provided that the fee is paid in the double amount.

  • Representation by a patent attorney

For foreign applicants, it is necessary to perform entry into the Saudi PCT national phase through an agent, a registered Saudi patent attorney.
