  • Trademark fees

  • Multiple-class applications

Multiple-class trademark applications are possible in Azerbaijan.

  • Minimum filing requirements

For obtainment of a filing date, it is necessary to provide the Azerbaijani Patent Office with name and address of the applicant, prints of the trademark, list of goods and/or services following the international classification and proof of payment of the prescribed fee.

  • Requirements for the Power of Attorney

An original Power of Attorney (no legalisation or notarisation is required) may be submitted simultaneously with filing an application or within two months from the filing date. In case the stamp is not available, the POA must be notarised.

  • Priority document

The priority document may be filed along with an application or within three months from the filing date. The Azerbaijani translation of the document submitted in other languages should be provided within two months after the date of document submission.

  • Opposition period

Оppositions against an Azerbaijani trademark application may be filed for national applications within the examination stage.

  • Validity term and trademark renewal

The trademark in Azerbaijan is valid for ten years from the filing date. A trademark may be renewed for successive periods of ten years within twelve months before the expiration date. It is possible to renew a trademark within a grace period of six months after the expiration date on condition that a surcharge is paid. Reinstatement of a lapsed trademark after grace period expiration is not possible.

  • Use requirement

The non-use grace period in Azerbaijan is five continuous years from registration. After its expiry, any interested party may initiate the cancellation action based on non-use to the Board of Appeal of Azerbaijan.

  • Representation by a trademark attorney

For the foreigners, it is necessary to perform a trademark prosecution in Azerbaijan through an agent, registered Azerbaijani trademark attorney.

  • What can be registered as a trademark in Azerbaijan

Words, personal names, letters, numerals, figurative elements, a shape of the goods or their packaging, combinations of colours, as well as any combination of such signs, may be registered as a trademark in Azerbaijan.
