  • Multiple design applications

Multiple design applications (up to 100) are possible in Lithuania.

  • Filing requirements for a design application in Lithuania

The official language of the proceedings before the patent office is Lithuanian; however, it is possible to submit the application in another language, provided that the translation thereof is filed within three months from the filing date.

To obtain the date of filing, it is necessary to submit:
- request to register an industrial design;
- representation of a design.

A certified copy of the Priority Document should be filed either on filing or within three months from the filing date.

The original of a simply signed Power of Attorney in case the applicant is a natural person or of a stamped and signed Power of Attorney in case the applicant is a legal entity should be filed within three months from filing a design application in Lithuania.

The document confirming the right to file a design application and the declaration regarding the authorship of the design should be provided.

The term for filing an industrial design application in Lithuania claiming priority is six months from the priority date.

  • Examination of a design application in Lithuania

Applications are examined as to compliance with the formal requirements, it is also checked whether the applied design is registrable according to the Lithuanian legislation. No substantive examination is stipulated, therefore, designs are registered at the liability of the applicant. The examination fee as well as examination request are not stipulated either.

  • Novelty grace period

Disclosure of the information about an industrial design within 12 months before the filing or priority date (if any) does not disprove its novelty according to the Lithuanian legislation.

Design registration in Lithuania is valid for five years from the date of filing. This term may be renewed every five years up to 25 years in total. Renewal fees are payable every five years, the first renewal fee is included in the fees for registration and publication. Further renewal fees should be paid within six months of the last design validity year. Late payment with a 50% surcharge is possible within a 6-months grace period.

On average, design registration procedure takes 6-12 months.

  • Representation by a patent attorney

For foreign applicants, it is necessary to perform design registration in Lithuania through an agent, a registered Lithuanian patent attorney.
