  • Design fees

  • Multiple design applications

Multiple design applications are possible in Turkmenistan.

  • Filing requirements in Turkmenistan

- A request to grant a patent on the industrial design containing information about the applicant(s) and designer(s);
- set of industrial design views;
- description of the industrial design.

  • Priority document

A copy of the priority document should be submitted to the Turkmen Patent Office within four months from the date of filing the application.

  • Power of Attorney requirements

A simply signed Power of Attorney should be provided within three months from the date of filing the application in case the applicant is a natural person, while for legal entities it should be signed and stamped. No notarization or legalization is required.

  • Examination of a design application in Turkmenistan

There are formal, preliminary, and substantive examinations. When the positive results of the formal examination are received, the application undergoes the preliminary examination. On the basis of the preliminary examination results, a decision to grant a Limited patent (valid for ten years) may be issued. To obtain a full patent (valid for fifteen years), it is necessary to file a request for suspension of issue of the Limited patent and request the substantive examination within five years from the filing date. The request for substantive examination may be filed by any interested party. Also, the applicant should submit a copy of a patent or a decision to grant a patent issued by other Patent Offices in respect of parallel patent applications.

  • Novelty grace period

Six months from disclosure of the information on an industrial design before the filing of the application or priority date thereof.

  • Grant and validity term

Official grant fees should be paid within three months from the date of issuance of the Notice of Allowance. The Limited patent on industrial design is valid for 10 years while the full patent is valid for 15 years. The first post-grant annuities starting from the 1st year should be paid simultaneously with official grant fees. All subsequent annuities are counted from the filing date and are to be paid before the beginning of the next year.

  • Representation by a patent attorney

For foreign applicants, it is obligatory to perform the patent prosecution in Turkmenistan through an agent, a registered Turkmen patent attorney.

  • What can be registered

Artistic designer solutions which determine an appearance of a product may be registered as an industrial design in Turkmenistan.

  • What cannot be registered

- solutions determined exclusively by a technical function of an article;
- solutions related to the object of architecture (besides small architectural forms), industrial, hydro-technical and other stationary facilities;
- printed production;
- solutions related to the objects of unstable forms from liquid, gaseous, powdery and similar substances;
- solutions contradicting to public interests, the principle of humanity and morality.
