  • Multiple-class applications

Multiple-class trademark applications are possible in Turkmenistan.

  • Filing requirements in Turkmenistan

The official languages of the proceedings before the Turkmen Trademark Office are Russian and Turkmen. An application should be filed in Russian and/or Turkmen; however, the documents accompanying the application may be filed in any language. The translation thereof should be submitted within 2 months from the filing date for foreign applicants and at the time of filing for nationals.

For obtainment of the date of filing a trademark application in Turkmenistan must contain:
- request for trademark registration;
- the applicant’s details;
- representation of the claimed trademark;
- a list of goods/services.

If priority is claimed, a certified copy of the Priority Document should be submitted to the Turkmen Trademark Office within 3 months from the date of filing.

The original of a sealed/stamped Power of Attorney should be provided within 2 months from the date of filing. In case the stamp is not available, the POA must be notarised.

  • Examination, publication and opposition of a trademark application in Turkmenistan

Trademark applications in Turkmenistan undergo both formal and substantive examination. After completion of the formal examination applications are published in the bulletin of Turkmenpatent. Any interested party may file an objection to the possible registration of the trademark during the period of examination.

  • Grant, validity term and trademark renewal

The official fee for registration must be paid within 3 months after issuance of the corresponding Notice of Allowance. The trademark in Turkmenistan is valid for 10 years from the filing date of the application and may be renewed every 10 years. An application for renewal must be filed within one year before the expiration date of the registration, or within the 6-month grace period after the expiration date of the registration.

  • Duration of registration procedure

In case the prosecution process goes smoothly, it takes from 1,5-2 years to obtain a trademark registration in Turkmenistan.

  • Use requirement

In case of continuous non-use of a trademark in Turkmenistan within any 3 years after its official registration any interested party may file a request for cancellation of the trademark. 

  • Representation by a trademark attorney

For foreign applicants it is obligatory to perform the trademark prosecution in Turkmenistan through a registered Turkmen trademark attorney.

  •  Note

Response to the provisional refusal of international trademark registration must be filed within 3 months from the date of notification of provisional refusal. This time limit can be extended up to 6 months. Response must be filed in Turkmen. It is necessary to appoint a local representative for filing the response and/or requesting a time extension. Final refusal may be appealed within 3 months after its issuance.
