• Multiple design applications

Multiple design applications are possible in Armenia (except ornaments), provided that all designs belong to the same class of the International Classification (except ornaments).

• Filing requirements of a design application in Armenia

The official language of the proceedings before the Armenian Patent Office is Armenian. Foreign applicants may submit an application in any other foreign language; however, Armenian translation of the application should be filed within three months from the date of filing.

To obtain the filing date, an applicant should provide the patent office with:
- a request to register an industrial design;
- applicant’s data;
- graphical representation of a design.

To confirm the right of priority, an applicant should provide a certified copy of the Priority Document within 9 months from the priority date.

The Power of Attorney must be submitted to the Armenian Patent Office simultaneously with filing an industrial design application or within 2 months after filing. Legalisation or notarisation of the POA is not required.

The term for filing industrial design applications claiming priority in Armenia is six months from the priority date. The right of priority may be re-established by paying an additional official fee.

• Examination of a design application in Armenia

Industrial design applications in Armenia undergo formal examination within 2 months from the filing date. The state authorized body shall conduct a substantive examination of the application within 3 months from the publication date of the application.

• Novelty grace period

Disclosure of an industrial design will be disregarded if it occurs within twelve months prior to the filing or priority date, and the information is disclosed by the designer (applicant), or a third party who directly or indirectly obtained information on the industrial design.

• Grant, validity term and design renewal fees

The official fees for grant and publication as well as the first renewal fee should be paid within three months from receipt of the notification about design registration. The initial validity term of an industrial design in Armenia is five years from the date of filing. This term may be renewed every five years up to a maximum of 25 years. The renewal fee should be paid in advance before the expiration of the current five-year validity term. Late payment is possible within 6 months from the expiration of the validity term, provided that the surcharge (50% of the renewal fee) is paid.

• Duration of registration procedure

In Armenia, approximate term from filing to registration of an industrial design is 12 months.

• Representation by an attorney

For foreign applicants, it is recommended to perform design registration in Armenia through an agent, a registered patent attorney. However, it is mandatory for foreigners to provide the patent office with the Armenian address for correspondence.
