Benelux: fee changes

On September 29, 2017, the Benelux Office for Intellectual Property has announced their decision to increase their fees associated with the protection of trademark and design rights. These new increased rates will take effect from January 1st, 2018.

Even though the costs have not been changed since 2005 the changes are rather nominal. The updated tariffs will see the filing of a trademark in one class at a cost of 248 EUR (240 EUR before changes) and a single industrial design at a cost 112 EUR (108 EUR before changes).  

The only significant fee changes apply to filing of multiple designs applications, where fee for designs from 2nd to 10th is increased from 54 EUR to 112EUR, and for 11th to 20th from 27 EUR to 56 EUR. All the other fees remain almost the same with minor changes up to 3-4% .

If you are considering filing a design patent application in the Benelux countries, it is advised that applications should be made before the end of the year to take advantage of the current cheaper rates.
