Kyrgyzstan: new fees implementation

The Regulations on fees for patents, utility models, designs, selection achievements, trademarks, service marks, appellations of origin of goods, providing the rights for use of appellations of origin of goods, and registration of patent attorneys adopted by the Government of the Kyrgyz Republic on October 3, 2016, were published in the Official Gazette on October 11, 2016. The Regulations enter into force within 15 days of its publication, i.e. October 26, 2016.

The Regulations introduce comprehensive changes of fees for all stages of the registration process. The said changes concern all intellectual property types, i.e. patents, utility models, designs, trademarks, etc.

The prevailing tendency in the implemented changes is slight increase in official fees. Thus, the average increase in filing fees for patents, utility models and designs constitutes about 10%. Fees for examination of patents and utility models have also been increased by 10%. Meanwhile, design examination is now cheaper than before; the reduction is around 40%. Registration fees have also been decreased by approximately 30%. Maintenance fees have risen by up to 10%.

Moreover, the conditions for providing fee reductions have become stricter, i.e. it is possible to obtain fee reduction only in case the only inventor is the only applicant while previously this condition was not taken into consideration. Reductions are available for natural persons and non-commercial institutions which may pay 10% of the total amount of fees and for people with serious disabilities who obtain 100% reduction. Additionally, fee reductions cover patent and utility model fees only.
