Poland: new trademark registration procedure
As of September 11, 2015, new trademark registration procedure was adopted by the Parliament of Poland. The amendments to legislation will enter into force on April 15, 2016.
The main changes are listed below:

The trademark applications will be examined only on formal requirements and absolute grounds for refusal without checking relative grounds. In a view of this, registration procedure will be shortened up to six months while currently it lasts more than a year.

The disclosure of a trademark application in the online database for filing third-party observations will be occurred within a period of two months from the filing date. Currently, information may be disclosed to the public after the Official publication (i. e. three months from the filing date).

After publication of the Polish trademark application in the Official Bulletin the owner of the prior or similar trademark will have an opportunity to file oppositions to the trademark registration within a non-renewable period of three months. Currently, as from the date of publication any third parties may acquaint themselves with the trademark application and with the list of the goods for which the mark is intended.
