On November 1, 2017, INDECOPI and the JPO make start of the PPH pilot programme

As of November 1, 2017, the The National Institute for the Defense of Competition and Protection of Intellectual Property of Peru (INDECOPI) and the Japan Patent Office (JPO) will launch a Patent Prosecution pilot programme.

With the introduction of the Patent Prosecution Highway applicants are given the opportunity to request acceleration of examination for an application in Peru if the corresponding application has been already examined by the JPO, and vice versa. With the help of this fast-track system an IPO can rely on the work products of corresponding offices during a substantive examination. Such cooperation between intellectual property offices makes the registration procedure more efficient and enticing to applicants.

According to Patent Prosecution Highway Portal Site, at the moment INDECOPI has PPH agreements with the Chilean National Institute of Industrial Property, Spanish Patent and Trademark Office, and IPOs of Argentina, Colombia, Mexico, Paraguay and Uruguay. Thus, the agreement with the JPO is even more important, as it makes Peru more attractive for Japanese applicants who have received positive results issued by the JPO.

Meanwhile, the Japan Patent Office has the most number of PPH agreements with the countries of Europe, Latin America, North America and Asia. It participates in numerous PCT-PPH agreements, and is a member of the Global PPH and the IP5 Patent Prosecution Highway pilots, apart from several PPH agreements which do not include PCT work products. The other two offices that take part in Patent Prosecution Highway in such active manner are the EPO and the USPTO.
