Slight changes to the IP fee schedule in Spain

The Spanish Patent and Trademark Office (SPTO) has updated its official fee schedule as of July 5, 2018.

The main changes concerned trademarks and collective marks, for which the fees for the whole registration process have been increased by 1%. In contrast, almost all common rates, including the fees for restoration, recordals or oppositions, have been decreased by about 2%.

The fees relating to patents and utility models have already been modified in 2017. Therefore, they remain unchanged with one exception for the preliminary examination fee, which has also been increased by 1%.

As for designs, all the registration fees, except for the opposition fee, have also been enlarged by up to 1%. On the other hand, the common design rates, such as restoration or recordal fees, have been reduced by almost 2%.

Although the Spanish government has established the general increase in the fee amounts, the common rates related to trademarks, collective marks and designs, have been decreased for unification reasons.
